West Bengal Assembly Speaker Biman Banerjee on Wednesday rejected a plea by opposition State Assembly leader Suvendu Adhikari to disqualify MP Mukul Roy, saying he “didn’t found no merit in the petitioner’s argument”.

On April 11, the Calcutta High Court overturned the President’s earlier order, dismissing a motion by Adhikari seeking Roy’s disqualification as a member of the House on the grounds of defection and reinstating the case for further consideration. . Speaking to reporters, Banerjee said: “I have heard from both sides and discussed in detail the previous rulings cited by the petitioner. I have come to the conclusion that the petitioner has failed to prove his claim. The petitioner has focused on electronic evidence. I took note of this evidence, and it also did not prove the charge.

According to TMC sources, the president’s order implies that Roy, who represents the Southern Assembly constituency of Krishnanagar in Nadia district, will remain a BJP MP.

Roy had defected to the ruling Trinamool Congress in June 2021, a month after winning Assembly elections on a BJP ticket. But, since he did not resign as a member of the House, Adhikari filed a disqualification petition against him before the president under the anti-defection law. In February, the President rejected the petition. Adhikari then challenged the order in the High Court.

Notably, another BJP MP, Ambika Roy, had also moved to the High Court in July last year, challenging Roy’s election as chair of the Public Accounts Committee and praying for the appointment of a member. of the opposition to the post, in keeping with tradition.

The case is pending before the court.
